Criminal Investigation

Strategic investigation support for criminal defense

Under the Colombian Accusatory Criminal Justice System, the defense has the constitutional right to conduct its own investigation. At Guevara Castaño Abogados we offer private criminal investigation services that strengthen our clients' defense with solid evidence and detailed evidentiary analysis.

Private Investigation and Evidentiary Analysis

Our criminal investigation services include: field investigation, witness interviews and location, document collection and authenticity verification, scene analysis, evidentiary chain-of-custody review, forensic computing, forensic psychology evaluations, and asset tracing. All activities are conducted under article 271 of the Code of Criminal Procedure (Law 906 of 2004), ensuring evidence admissibility at trial.

Our private investigation does not replace but complements the work of the Attorney General's Office (Fiscalía), focusing on the defense's theory of the case. This approach allows us to challenge the prosecution's case from a position of evidentiary strength.

What our clients ask

Our private criminal investigation services include: field investigation (witness interviews, document collection, scene analysis), evidentiary analysis, witness location, document authenticity verification, forensic computing, forensic psychology evaluations, and chain-of-custody analysis. These services support technical defense by providing solid evidence to challenge the prosecution's case.

Under the Colombian Accusatory Criminal Justice System, the defense has the constitutional right to conduct its own investigation parallel to that of the Fiscalía. Private investigation focuses on the defense's theory of the case, gathering evidence to refute imputed facts, support alternative versions, or identify procedural defects. All evidence is collected in compliance with constitutional and legal guarantees to ensure its admissibility at trial.

Yes. Private investigation in service of criminal defense is recognized by Colombian law. Article 271 of the Code of Criminal Procedure (Law 906 of 2004) regulates investigative activities by the defense, including the search for and collection of evidence, expert reports, and witness interviews. All activities must respect fundamental rights and the legal framework.

Private investigation is especially valuable: (i) in complex cases requiring evidence gathering beyond what the Fiscalía investigated; (ii) when alternative versions to the prosecution's theory need to be substantiated; (iii) when procedural defects or chain-of-custody issues must be evidenced; (iv) in cases involving cybercrime, financial fraud, or technical evidence requiring forensic computing; and (v) when victim location, asset tracing, or witness corroboration is needed.
